This letter outlines the basis of the transfer of CUBRIC Data (as defined below) to

“the User” by

Cardiff University Brain Research Imaging Centre (“CUBRIC”), School of Psychology, part of Cardiff University, located at Maindy Road, Cardiff, CF24 4HQ;

CUBRIC has collected neuroimaging and audio data (“CUBRIC Data”) as a result of the use of the MRI and a compatible microphone Systems at the Maindy Rd. site. CUBRIC is willing and able to make the selected data available to users within Cardiff University and at other institutions (“the User”) for research and education purposes subject to the User being aware of and complying with specific obligations (“CUBRIC Obligations”) relating to the use of the CUBRIC Data. 

This document outlines the CUBRIC Obligations which the User must respect when using the CUBRIC Data. It covers the arrangements which are needed to ensure effective and efficient research governance and aims to establish a clear understanding of the roles and responsibilities of the User. 

The User agrees that any breach of this letter by the User or the User’s Team may put Cardiff University in breach of its obligations to its funders. If the User is an employee of Cardiff University, this may be regarded as a breach of the User’s employment contract with Cardiff University. 

CUBRIC is willing to provide the CUBRIC Data to the User solely for the purposes of the Project and expects the User to be mindful of the obligations set out in this letter. 

The User shall use the CUBRIC Data for the purposes of the Project only. The User shall not use the CUBRIC Data for any commercial purpose or for commercially sponsored research without seeking written consent from CUBRIC. 

The User shall keep all CUBRIC Data securely and use the CUBRIC Data in compliance with all applicable laws, regulations, and guidelines for the purposes of and for the duration of the Project. 

The CUBRIC Data will be received by the User and will not be transferred, distributed, released or disclosed by the User to any other organisation or institution including without limitation to any members of the User’s Team who is not employed by the User’s employer (which is likely to include any students or NHS employees who only hold honorary contracts with the User’s employer) without their adherence to the obligations outlined in this agreement. 

By downloading this data, the User acknowledges that the data will not be shared with any internal collaborator without their acknowledgement of the obligations outlined in this letter. All collaborators must acknowledge that the CUBRIC Obligations will be adhered to, so as to ensure compliance with the CUBRIC Obligations. 

The User shall have appropriate measures in place to ensure the confidentiality of the CUBRIC Data in the User’s custody and shall not attempt to obtain information identifying the individuals who have provided the CUBRIC Data. It is imperative that the User does not and procures that the User Team does not try to identify any individuals from the CUBRIC Data provided. 

The User agrees that the CUBRIC Data is confidential in nature and that it shall not share any confidential information with any third parties without the prior written consent of CUBRIC. 

The User shall be permitted to publish and disclose information pertaining to or resulting from the User’s use of the CUBRIC Data provided always that all such publications should acknowledge CUBRIC’s involvement as the source of the CUBRIC Data in accordance with normal academic practice and/or acknowledgement, as defined in Schedule 1. 

The Results and any intellectual property rights in relation to the same shall be treated in accordance with any agreements in place under which the User conducts the Project. 

The CUBRIC Data are, and shall remain at all times, the sole property of Cardiff University under the curation of CUBRIC and all unused CUBRIC Data including all copies, replications and documents or files containing the same whether in hard copy or electronic copy shall be immediately returned to CUBRIC (or if CUBRIC so requires, destroyed) upon the earlier of: 

  1. expiry of the Term; 
  2. at CUBRIC’s request.

SCHEDULE 1 

Description of the Project:

The Welsh Government has set the promotion of the Welsh language as a priority by launching the “Cymraeg 2050” strategy, which aims to increase the number of speakers to 1M by 2050. As well as increasing the transmission of Welsh in the home, a large part of this strategy relies on successfully teaching the language to children and adults. Welsh has some sounds and pronunciation patterns that are uncommon in other languages and can therefore cause difficulties for those learning it. In this project, we provide insights into the pronunciation of Welsh language by employing state-of-the-art magnetic resonance imaging (MRI). More concretely, we utilise MRI to generate videos of the anatomical vocal tract movement of Welsh speakers of different dialects while reading a specifically designed script. Aided by an MRI-compatible microphone, we generate a unique set of multimedia resources that will be disseminated through a purposely developed website.
